# Terms of Service

These are the terms that apply when you use the FixMyMarketing Scanner. Please read them — they're written in plain English and they're shorter than most.

1. Who we are and what these terms cover

The FixMyMarketing Scanner is operated by Story Advantage (Pty) Ltd, a company registered in South Africa, trading as Story Advantage Marketing Agency. In these terms, "we", "us" and "our" refer to Story Advantage. "You" and "your" refer to the person or business using the Scanner.

These terms cover your use of the FixMyMarketing Scanner — including the free scan, the paid Brand Resonance Review, and the WhatsApp service. If we offer additional products in the future (consulting, sprints, courses, integrations) we'll cover those in separate or supplementary terms.

By using the Scanner, you agree to these terms. If you don't agree, please don't use it.

2. The service

The FixMyMarketing Scanner analyses publicly accessible websites using our Brand Resonance methodology — a framework for diagnosing why a website does or doesn't convert visitors into customers. We score the site across eight dimensions and produce a report with findings and recommendations.

Free scan. Submit a URL and get a basic Brand Resonance Score with your top issues. No payment required.

Paid Brand Resonance Review. The full deep review with AI-detected ICP, priority matrix, implementation playbooks, multi-page SEO audit, vision analysis, and a 90-day roadmap. Priced per scan.

WhatsApp service. You can run the entire flow from WhatsApp — submit your URL, complete the POPIA consent step, receive your score, and upgrade to the paid review without leaving chat.

What we don't do: bypass authentication, defeat access controls, ignore `robots.txt`, or scrape content from behind login walls. We only analyse what's publicly reachable.

3. You must be at least 18

The Scanner is for businesses and adults. By using it, you confirm you're at least 18 years old and have the legal capacity to enter into this agreement. If you're using the Scanner on behalf of an organisation, you confirm you have authority to bind that organisation to these terms.

4. Your responsibility when scanning

When you submit a website to the Scanner, you confirm that at least one of the following is true:

  • You own the website, or
  • You have permission from the owner to scan it, or
  • The scan falls within the website's own terms of automated access (within `robots.txt`, not rate-limited, no scraping prohibition).
  • We record your confirmation against each scan as evidence. On WhatsApp, your "YES" reply to our POPIA consent question is recorded with a timestamp and the exact prompt text we asked.

    Indemnity. You will defend us from any third-party claim arising directly out of your breach of this section 4, and pay any damages, costs, or settlement amounts a court awards in such a claim. This indemnity does not apply to claims caused by our own negligence or wilful misconduct.

    5. Acceptable use

    You may not:

  • Scan websites that disallow automated access in their `robots.txt` or published terms.
  • Use the Scanner to enumerate vulnerabilities, test security controls, or do anything that could reasonably be construed as unauthorised access.
  • Resell, sublicense, or white-label Scanner reports without a written commercial agreement with us.
  • Circumvent rate limits (including by creating multiple accounts or using multiple phone numbers).
  • Use the Scanner to defame, harass, or competitively disparage any business based on its scan results.
  • Reverse-engineer our scoring methodology or use the Scanner to build a competing product.
  • Free scans are capped at five per phone number or account per 24-hour rolling window. Paid reviews don't have this cap.

    6. Accounts

    You can use the Scanner via:

  • A web account (email and password) at tools.fixmymarketing.co.za, or
  • A WhatsApp-keyed lite account (we identify you by your WhatsApp phone number after you've given POPIA consent).
  • If you create both, we may link them so your scan history is unified.

    You're responsible for keeping your login credentials secure. Tell us immediately if you suspect unauthorised access. We may suspend or terminate any account that violates these terms.

    7. The WhatsApp service

    When you message our WhatsApp business number, you'll be guided through the scan flow as described in section 2.

    POPIA consent. Before we run any scan, we'll ask you to confirm permission to scan the URL. Your "YES" reply, the timestamp, and the consent prompt text are stored as evidence of consent under the Protection of Personal Information Act, 2013.

    Universal commands. At any time you can reply:

  • STOP — we'll add your number to our suppression list and stop sending you messages.
  • START — if you previously sent STOP, this opts you back in.
  • HELP — short help message.
  • Marketing follow-ups. After you complete a free scan, we may send you one follow-up message approximately 24 hours later with a discount on the paid review. This is not a subscription — there's no ongoing drip campaign. If you'd rather not receive it, reply STOP at any time.

    Costs. We don't charge you to use the WhatsApp service. Your mobile carrier's standard data or messaging rates may apply.

    Rate limit. Five free scans per phone number per 24 hours. Sixth attempt gets a polite "try again tomorrow" reply.

    Email communications. After you submit a scan with your email address, we may send you:

  • The scan report and any branded PDF attachments,
  • A short follow-up email sequence about your results, related tips, and the paid Brand Resonance Review,
  • Occasional updates about Scanner improvements or new features.
  • Every marketing email includes an unsubscribe link, which removes you from non-essential sequences. Transactional emails (the report itself, password resets, payment receipts) can't be unsubscribed from — you'll only receive those if you've taken an action that requires them.

    8. Payment and refunds

    The paid Brand Resonance Review is currently priced in South African Rand (ZAR) and processed by Payfast. International customers can pay — Payfast handles currency conversion at the card-network rate. We may add other payment processors and currencies in future.

    Refund policy: all sales are final once the report is delivered. If your report fails to deliver due to a technical error on our side, contact us within 7 days of purchase and we'll regenerate the report or refund the purchase, at our discretion. Refunds are not available for buyer's remorse, disagreement with the report findings, or for change of mind after the report has been delivered.

    9. Intellectual property

    Your stuff stays yours. You retain all rights to your website, your business data, and anything you submit to the Scanner.

    Our stuff stays ours. We retain all rights to:

  • The Brand Resonance methodology and the eight-dimension framework.
  • Our scoring algorithms, models, and analysis pipeline.
  • The Scanner software, UI, branding, and documentation.
  • Licence to improve the service. By using the Scanner, you grant us a perpetual, irrevocable, royalty-free, non-exclusive, worldwide licence to use the URLs you submit, the scan results we generate, and your aggregated usage data:

  • to improve our scoring models and methodology,
  • to train, fine-tune, or evaluate AI systems we use to power the Scanner,
  • to produce anonymised, aggregated benchmarks, research, and marketing content (e.g. "average Brand Resonance Score across SaaS sites scanned in 2026").
  • We will not publish your specific scan results, your website URL, or any identifying details without your prior written consent. "Anonymised and aggregated" means no individual person, business, or website can be reasonably identified from anything we publish.

    10. AI-generated content

    The Scanner uses artificial intelligence — including third-party large language models — to analyse websites and generate findings.

    AI systems can make mistakes, including factual errors, misinterpretations of your website, and recommendations that don't suit your specific context. Reports are advisory only. They are not professional marketing, legal, financial, accessibility, or compliance advice.

    You are responsible for verifying any recommendation before acting on it. We do not guarantee that following Scanner recommendations will improve your conversions, your revenue, or any other commercial outcome. Marketing is not deterministic.

    11. Warranty disclaimer

    The Scanner is provided "as is" and "as available". We do not warrant that the service will be uninterrupted, error-free, or fit for any particular purpose. To the maximum extent permitted by law, we exclude all warranties, conditions, and representations that are not expressly stated in these terms.

    12. Limitation of liability

    To the maximum extent permitted by law:

  • We are not liable for indirect, incidental, consequential, special, or punitive damages — including lost profits, lost revenue, lost data, or business interruption — arising from your use of the Scanner.
  • Our total aggregate liability for any claim arising from your use of the Scanner is limited to the amount you actually paid us in the 12 months immediately preceding the event that gave rise to the claim. If you've only used the free scan, our liability is capped at ZAR 1,000.
  • Nothing in these terms limits liability that cannot lawfully be limited (for example, liability for death or personal injury caused by our negligence, or for fraud).

    13. Third-party services

    To deliver the Scanner, we route data through third-party processors. By using the Scanner, you accept that these third parties may receive the relevant information:

  • Microlink — receives the submitted URL to generate screenshots.
  • Google PageSpeed Insights — receives the submitted URL to measure performance.
  • Anthropic — receives extracted website content for AI analysis.
  • MailerLite — sends your scan reports, transactional emails, and marketing email sequences. Receives your email address, name, and the scan metadata needed to personalise the messages.
  • Payfast — receives payment information for paid reviews.
  • Evolution API / Meta WhatsApp — receives messages and phone numbers for the WhatsApp service.
  • Supabase — stores your account data and scan results (data hosted in South Africa).
  • Vercel — hosts the Scanner application.

    14. Changes to the service and these terms

    We may change the Scanner's features, pricing, or availability at any time. We may also update these terms.

    For changes that materially affect paying customers (significant feature removal, pricing change, materially worse terms), we'll give at least 14 days' notice — by email to the address on file and/or by a notice in the Scanner dashboard or via WhatsApp.

    For other changes, the updated terms take effect when posted at tools.fixmymarketing.co.za/terms. The "last updated" date below tells you when we last revised them.

    If you don't agree to a change, your remedy is to stop using the Scanner. Continued use after a change takes effect counts as acceptance.

    15. Termination

    You can leave at any time. Delete your web account from your dashboard, or reply STOP on WhatsApp to opt out. We may also let you request full account deletion via email if you can't access the dashboard.

    We can terminate accounts that breach these terms, with or without notice, depending on severity.

    What happens to your data on termination is described in our Privacy Policy. In summary: identifying data is deleted within a reasonable period; anonymised aggregated data may persist for benchmark and research purposes per section 9.

    Sections that should logically survive termination (intellectual property, indemnity, limitation of liability, governing law) survive.

    16. Governing law and dispute resolution

    These terms are governed by the laws of the Republic of South Africa. Any dispute arising out of or in connection with these terms or your use of the Scanner will be heard in the competent courts of South Africa, regardless of where you are located.

    Before starting any court proceedings, please contact us at the email below. We'll try to resolve things directly within 14 days.

    17. General provisions

    Entire agreement. These terms (together with our Privacy Policy) are the entire agreement between you and us about the Scanner. They replace any earlier agreement, representation, or understanding.

    Severability. If any part of these terms is found invalid or unenforceable, the rest stays in force. The invalid part will be modified to the smallest extent necessary to make it enforceable.

    No waiver. If we don't enforce a right or term, that doesn't mean we've waived it.

    Assignment. You may not transfer your rights or obligations under these terms without our written consent. We may transfer our rights and obligations (for example, in a sale or restructure of the business) — we'll let you know if that happens.

    Force majeure. Neither party is liable for failure or delay caused by events outside their reasonable control — including but not limited to natural disasters, internet outages, government action, third-party service failures (Anthropic, Vercel, Supabase, Payfast, WhatsApp), and infrastructure attacks.

    Notices. We can give you notice by email to your registered address, by message via WhatsApp (for WhatsApp-only users), or by a banner inside the Scanner. You can give us notice at the email below.

    Relationship. Nothing in these terms creates a partnership, agency, employment, or franchise relationship between us.
